Bask Tunvel respects the intellectual property rights of others and expects users of our services to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA) and other applicable intellectual property laws.

Notification of Copyright Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via our service, please notify our copyright agent as specified below. For your complaint to be valid under the DMCA, you must provide the following information in writing:

Your contact information, including your address, telephone number, and email address.

5. Good Faith Statement

A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.

6. Accuracy Statement

A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Counter-Notification

If you believe that material you posted was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us by providing the following information in writing:

1. Your Physical or Electronic Signature

Your physical or electronic signature.

2. Identification of Material

Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.

3. Good Faith Statement

A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

4. Your Contact Information

Your name, address, telephone number, and email address.

5. Consent Statement

A statement that you consent to the jurisdiction of the court in your location, or if outside Kazakhstan, that you consent to the jurisdiction of the courts where Bask Tunvel is located, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Repeat Infringer Policy

In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our service and terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Processing Time

Upon receipt of a valid DMCA notice, we will remove or disable access to the allegedly infringing material promptly. We will notify the user who posted the material of the removal or disabling of access.

If we receive a valid counter-notification, we will forward it to the person who submitted the original DMCA notice. If the original complainant does not file a court action seeking an order to restrain the user from engaging in infringing activity relating to the material within ten business days, we may restore the removed material or cease disabling access to it.

False Claims

Please note that under applicable law, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability.

Modifications to This Policy

We reserve the right to modify this DMCA Policy at any time. Changes and clarifications will take effect immediately upon their posting on this page. If we make material changes to this policy, we will notify you by updating the date at the top of this policy.
